By using everwell360.com (the “Site”), you agree to these Terms. If you do not agree, please do not use the Site. The Site is operated by Gunardi Irawan, MD (“the Practice,” “we,” “us”).
1. Purpose of the Site. The Site provides information about the Practice and general health education. It does not provide medical advice, and using it does not make you a patient. Our Medical Disclaimer is part of these Terms.
2. Appointment requests. Submitting the appointment-request form is a request only. It does not reserve a time, and we may decline to schedule for any lawful reason, including insurance we do not accept or a full panel. You agree to provide accurate contact information and not to submit requests on behalf of someone else without their permission.
3. Acceptable use. You agree not to use the Site to send spam, automated submissions, malicious code or unlawful content; not to attempt to access any non-public part of the Site; and not to copy the Site’s content for commercial use without our written permission.
4. Content and intellectual property. Text, images, logos and other content on the Site belong to the Practice or its licensors and are protected by copyright and trademark law. “EverWell” and “EverWell360” are names used by the Practice. You may read, print and share links to Site pages for personal, non-commercial use.
5. Reviews. Patient reviews displayed on the Site are republished from Google. They are the opinions of their authors, and we do not edit them. Posting a review on Google is governed by Google’s terms.
6. Third-party sites. Links to other websites, including the Patient Gateway portal, are provided for convenience. We are not responsible for their content, availability or privacy practices.
7. No warranties. The Site is provided “as is” and “as available.” We make no warranty that the Site will be uninterrupted, error-free or free of harmful components, or that its content is complete or current.
8. Limitation of liability. To the fullest extent permitted by law, the Practice is not liable for any indirect, incidental or consequential damages arising from your use of, or inability to use, the Site or its content. Nothing in these Terms limits liability for medical care actually provided to a patient of the Practice, which is governed by the clinician-patient relationship and applicable law, not by these Terms.
9. Privacy. Our Privacy Policy explains how Site information is handled and is part of these Terms.
10. Changes. We may update the Site and these Terms at any time by posting the revised version with a new effective date.
11. Governing law. These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law rules. Any dispute about the Site will be brought in the state or federal courts located in Worcester County, Massachusetts.
